SPECIFICATIONS

1. Site Licensees:

1.1     Contractor must have a site license for each landfill that will be used under this Contract, approved and licensed by the Department of Natural Resources.   

1.2     Contractor must be licensed to transport waste materials by the Department of Natural Resources if using a transfer facility prior to landfill.

2.      Notice of Citations and Violations:
Contractor shall provide the University a notarized statement signed by an officer of the Contractor’s company, listing  all environmental and safety citations, violations, notices, and/or legal actions against it, pending or filed within the previous five years, together with actions taken by the Contractor to alleviate the deficient conditions.

3.      Applicable Laws:         

3.1     This Contract shall be governed and interpreted under the laws and administrative code of the State of Wisconsin.  The Contractor’s performance under this Contract shall at all times comply with and observe all federal, state and local laws, regulations, rules, ordinances or standards in effect during the period of this Contract which affects the work or its conduct.

3.2     The Contractor’s facilities or any facilities used by the Contractor to perform work under this contract shall be certified, registered, permitted and licensed as required by Federal, State and local agencies to perform the work required under this Contract. 

4.        Waste Categories: The final disposition of all waste materials delivered by the University to the Contractor must be received and disposed of at an approved and licensed landfill.  The following categories are used to define the types of waste materials for which the Contractor shall be responsible to landfill:         

4.1     General Waste: Contractor’s waste receiving for General waste must have paved road surface to the dumping/transfer site. The road shall not be excessively dusty and should be free of sharp Items that might puncture truck tires. The dumping/transfer site must be concrete, with a clean and level surface free of sharp objects which might puncture tires. General Waste: Means the following categories:

4.1.1     Commercial and Household Solid Waste:  Means waste generated by offices, food service/restaurant facilities, dormitories, laboratories (including animal waste) which is subject to decomposition.

4.1.2     Decontaminated Bio hazardous Waste:  Means medical or infectious waste materials that are from a treatment or research area, placed in either orange plastic bags and have been autoclaved to render waste non-infectious.

4.1.3     Broken Glass:  Means medical equipment or clinical laboratory articles that may cause punctures or cuts that have been autoclaved to render them non-infectious.  This includes, but is not limited to:  broken glass or plastic rigid vials, glass slides and cover slips, pipettes, Pasteur pipettes, glass bottles and other glass items likely to break during transit.               

4.1.4     Concrete Rubble:  Means concrete removed from road and sidewalk demolitions.

4.1.5     Construction And Demolition Waste:  Means waste resulting from the construction, demolition or razing of buildings and other structures.  Construction waste typically consists of concrete, bricks, bituminous concrete, wood, glass, masonry, roofing, siding, drywall and plaster, alone or in combination.

4.1.6     Waste Tires:  Means all vehicle tires.

5.        Waste Exclusions:  The University will not deliver and the Contractor shall not be expected to accept any hazardous waste, refrigeration units, asbestos, yard, hazardous chemicals, or any other problematical wastes banned by the County, State, or waste regulatory authority.

6.        Licenses and Permits:  Contractor shall be financially responsible for obtaining all required permits, licenses, and bonds to comply with pertinent Board of Regents, University of Wisconsin System regulations, and municipal, county, state and federal laws, and shall assume liability for all applicable taxes including but not restricted to sales and property.

7.        Landfill or Transfer Facilities: 

7.1      Contractor shall maintain an approved and D-N-R licensed landfill or transfer facility in accordance with Township, County and State sanitation regulations and zoning codes to receive the type(s) of University waste categories as listed.

7.2      All landfill sites or transfer facilities shall conform to all ordinances regulations pertaining to such disposal and sites.  The use of any site(s) used under this Contract shall not be at any additional cost to the University.

7.3      Contractor shall not change the landfill or transfer facility location, in place at the time of Contract award, without the written approval of the University’s Contract Administrator.

7.4      Contractor’s landfill site or transfer facility shall include a scale which must be located on Contractor’s premises and must be under State of Wisconsin certification to ensure net results through accurate gross and tare measurements.  The scale must be able to accommodate fully loaded vehicles up to 35 tons.  The scale must have a means for generating accurate dated weight slips for each weighing transaction.

7.4.1  Contractor’s scale shall be calibrated at a minimum of annually. Calibration records shall be available per request.

8.      Delivery Of Waste By University Vehicles:  Contractor shall make every possible effort to allow University vehicles to deliver their loads and depart immediately without delays.  If unreasonable delays occur, Contractor and University shall attempt to resolve the problem.  If repetitive delays persist, the University may choose to terminate and re-solicit the services under this Contract.

9.      Load Tickets:  Contractor shall provide a weight ticket for each load; and tickets shall include date, weight, load type and UW vehicle number.  The weight tickets shall be given to the University truck driver before the University vehicle leaves the Contractor’s facility.

9.1     The Contractor shall notify the University within 30 days of any of the following conditions at any facility utilized or intended to be utilized under this Contract:

9.2     Significant (as defined by applicable regulations) releases of hazardous substances to the environment.

9.3    Voluntary or agency-mandated environmental cleanups.

9.4     Notice of regulatory violations, citations or investigations.

10.     Hours of Operation:  Contractor’s facility shall be accessible to University vehicles six days a week, specifically Monday through Friday, all day generally 6:00AM to 4:00PM; and Saturday, mornings generally 7 to noon, 52 weeks a year.

11.     Right To Inspect Contractor Facilities: The Contractor shall allow the University to inspect all Contractor sites upon University request(s).
